• On this Site.
• From your use of the Service.

This policy does not apply to information collected by any third party including our affiliates and subsidiaries, including through any application or content (including advertising) that may link to or be accessible from or on the Site. Please read this policy carefully to understand our policies and practices regarding your information. By accessing or using this Site or the Service, you agree to this privacy policy. This policy may change from time to time. Your continued use of this Site or the Service after we make changes is deemed to be acceptance of those changes.

• Sign-up, account, and contact data: Information you provide to provision and sign into your account, including the stable identifier for your GitHub account, which is how you are recognized across sessions, display name, email address, and GitHub organization membership.
• Operational telemetry, including access IP addresses, sign-in timestamps, and other usage and performance data.
• Information you send: including feature requests, bug reports, support requests, and other correspondence.

We use information that we collect about you or that you provide to us, including any personal information:

• To present the Site and its contents to you.
• To process your sign-in and use of the Draftplane Service.
• To provide you with notices about your account, including updates to terms of use and suspension notices.
• To improve our products, services and websites.
• To notify you about changes to the Site or any products or services we offer or provide through it.
• To follow up with you after you have communicated with us or submitted information to us.
• To respond to your requests, including requests for newsletter subscriptions, materials, pricing and so on.
• For any other purpose with your consent and to fulfill any other purpose for which you provide it.
• To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
• As otherwise specified in this Privacy Policy and/or at the point of personal data collection.

Plan Data

Draftplane provides a hosted Service for storing, sharing and providing coding development plans that you upload (“Publish”) to review with members of your organization.

• When you publish plans to the Service for sharing with teammates, the Service stores the exact content of the plan and review data (comments, replies, resolutions, approvals). It does not store the file system paths of plans that tracked local files.
• Draftplane stores and serves your plans and their review history with the sole purpose of providing them to you and the members of the organizations you published them to. No one at Draftplane accesses the contents of your plans, unless legally obligated to as the result of a valid legal process, or when part of a support request in which you give Draftplane explicit permission to access them for the purposes of troubleshooting. If Draftplane believes your account may be in violation of the Terms of Use, Draftplane reserves the right to take remedial action as described in those terms.

We may disclose aggregated, anonymized information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or you provide as described in this privacy policy:

• To our affiliates, contractors, service providers, and other third parties we use to support our business and operations, e.g., delivery services, financial institutions, fulfillment services, technical support, e-commerce and other web-related services such as web hosting and web monitoring who have agreed to maintain confidentiality and only for the purpose of providing the Service.
• To a buyer or successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Draftplane LLC’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Draftplane LLC about the Site and Service users is among the assets transferred.
• To fulfill the purpose for which you provide it or for any other purpose disclosed by us when you provide the information.
• With your consent.
• To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
• To support any actual or threatened claim, defense or declaration in a case or before any jurisdictional and/or administrative authority, arbitration or mediation panel; or in connection with disciplinary actions/investigations.
• To identify, contact or bring legal action against someone who may be causing injury to or interfering with Draftplane LLC’s (or others’) rights or property.
• To enforce or apply our terms of use and other agreements between you and Draftplane LLC.

We have implemented measures to secure your personal information from loss and unauthorized access, alteration, and disclosure. However, there is no such thing as 100% secure, and no internet communications are completely secure or error-free. By transmitting personal information, you do so at your own risk. Draftplane LLC is not liable or responsible for the breach of any privacy settings or security measures implemented on the Site.

This Site and the Service are not intended for children under 18 years of age. No one under age 18 may provide any information to the Site or Service. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this Site or the Service or on or through any of its features, sign into the Service, or provide any information about yourself to us, through the Site, Service or otherwise.

Draftplane is operated by Draftplane LLC, an Oregon limited liability company, and Draftplane LLC is the controller of the personal data described here.
